Package Protection - Policy

Policy Summary

The below listed information is the Guaranteed Delivery Policy of Kinkly Shop (hereinafter, the “Company”), effective from July 1st, 2025, corresponding to the Guarantee Delivery Service (hereinafter, the “Service”).

1. General Conditions

1.1 Coverage

By subscribing to the Guaranteed Delivery Policy, the User agrees to the Terms of this Policy and represents that the Policy covers the following:

a) Lost Packages
  • Domestic Shipments: Considered lost if not marked "delivered" and no tracking updates for 7 days after shipment.
  • International Shipments: Considered lost if no tracking updates for 20 days after shipment.
  • Estimated Delivery Date Passed: Considered lost if 48 hours have passed since the estimated delivery date without updates or delivery.
  • Partial Deliveries: Missing packages from a multi-package order are considered lost.
b) Stolen Packages
  • Marked as "Delivered" but Not Received: Considered stolen.
  • Filing Timeframe: Claims must be submitted between 5 and 30 days after the package was marked as delivered.
c) Damaged Items
  • Items Damaged During Transit: Covered with photographic evidence.
  • Claim Requirements: Photo evidence must be provided to approve damage claims.

1.2 Exclusions from Coverage

The following situations are excluded unless explicitly agreed upon in writing by the Underwriter:

  • Incorrect Address: Not covered if shipped to an invalid or undeliverable address.
  • Delivery Barriers: Not covered if delivery location is inaccessible or delivery was refused.
  • Carrier Issues: Packages marked "return to sender" or held in customs are not covered.
  • Delayed Shipments: Not covered unless the delay meets the criteria for a lost package as outlined above.

2. Claim Filing Requirements

The following timelines must be adhered to in order for a claim to be processed:

a) Lost Packages (Not Marked as Delivered)
  • Domestic Shipments: File no sooner than 7 days after the scheduled delivery date.
  • International Shipments: File no sooner than 20 days after the scheduled delivery date.
  • Maximum Filing Deadline: File within 30 days of the last tracking update.
b) Stolen Packages (Marked as Delivered)
  • File within 30 days from the date and time the carrier marked the package as delivered.
c) Additional Requirements for Stolen Packages
  • Underwriters may request a police report and/or a signed affidavit.
  • Alternatively, video evidence may be accepted as proof of theft.
d) Damaged Items
  • Claims must be filed as soon as reasonably possible after discovering the damage.
  • Photographic evidence is required.

3. Limits of Liability

The Company’s liability for all claims under this Policy shall not exceed a maximum aggregate amount of USD 1,000 (One Thousand United States Dollars).

4. Geographical Limits

This Policy applies exclusively to individuals residing in the United States at the time of purchase, regardless of the origin of the transaction. It does not apply to individuals residing outside the U.S.

5. Further Clarifications

The Company reserves the right to determine the appropriate resolution for each valid claim. Resolutions may include reshipment, refund, or store credit, and will be determined based on the specific circumstances of the claim.
