Solicitation is a criminal offense when it pertains to sexual solicitation or prostitution. To be charged with solicitation, the actual consummation of the sex act is not required. Just agreeing to exchange sex acts for money is enough. Penalties differ depending on the location of the solicitation and its circumstances.

Several parties can be charged with solicitation of prostitution. Punishment varies, according to their involvement. A person that offers sex in exchange for cash can be charged similarly to a person who buys sex. Likewise, a negotiator may be involved in the transaction. This third party is often referred to as a pimp or madame. Their involvement carries stiffer criminal sanctions.
